The German Association of Psychologists (BDP) has expressed its support for the government's plans to implement measures to protect sensitive data in electronic health records (eHR). The association, which represents the professional interests of psychologists in all fields of activity, has repeatedly drawn attention to the data protection problem, particularly with regard to sensitive data from psychotherapeutic and psychiatric treatments.

In a press release dated August 12, 2025, the BDP welcomed the government's plans, calling the draft law a good and sensible solution for the current precarious situation in the area of storage, transfer, and use of eHR data, particularly highly sensitive data. The draft law in question is the Act on Expanding Powers and Digitization in Nursing Care from 06.08.2025.

The new regulations allow for exceptions to the storage obligation for highly sensitive data in eHR if there are significant therapeutic reasons or other significant rights of third parties that stand in the way. Treating physicians could also refrain from storing treatment data in the eHR in the event of visible risks.

The draft law establishes a further exception to protect patients under the age of 15, allowing for the withholding of certain information if there are serious indications of a risk and possible access to the information by guardians or other authorized persons would jeopardize the effective protection of minors.

The BDP Vice President, Susanne Berwanger, explained that the planned legal amendments would be a step in the right direction for addressing the current challenges in the area of eHR data protection.
