Advocacy: Establishing a sanctuary for transgender individuals in New York City is of utmost importance
New York is standing firm against federal anti-trans policies initiated during the Trump administration, taking decisive steps to protect and expand the rights and access to healthcare for transgender and gender nonconforming (TGNC) individuals.
In response to the Trump administration's efforts to eliminate gender-affirming care, New York enacted shield laws starting in 2023 to protect healthcare providers, patients, and their families from out-of-state prosecutions. These laws were further broadened in mid-2025, shielding all professionals involved in gender-affirming care from cooperation with out-of-state investigations or subpoenas. The attorney general is empowered to defend providers against legal threats, and parents and guardians of trans youth receiving care are protected as well.
New York Attorney General Letitia James is leading a coalition of states in suing the Trump administration to block federal actions that threaten to withhold funding from hospitals providing gender-affirming care to minors and to stop federal investigations targeting care providers. This lawsuit challenges the constitutionality of executive and DOJ orders designed to restrict care nationally, highlighting the conflict between federal efforts and state laws that protect transgender healthcare access.
In addition to legal protections, New York City's Department of Health and Mental Hygiene is required to create a citywide health agenda for TGNC New Yorkers. The legislative package also includes a "know your rights" public service campaign for TGNC New Yorkers to increase awareness of their legal protections.
The legislative response in New York City is a decisive response to the hurricane of anti-trans vitriol from Washington, D.C., but it must only be the beginning of a sustained campaign to protect transgender individuals throughout the state. A series of resolutions were passed urging Albany leaders to bolster legal protections for TGNC individuals and care providers throughout New York state.
The TGNC community in New York faces persistent economic and housing instability, with TGNC people disproportionately likely to be unemployed and more than a quarter of LGBTQ youth experiencing homelessness at some point in their lives. Along with mental health struggles, these challenges underscore the need for comprehensive legal and healthcare protections.
New York City's LGBTQIA+ Caucus has taken the first steps to bolster defenses for the TGNC community, recognising the importance of this vulnerable group. The city's rich history as the birthplace of the queer liberation movement, which began at the Stonewall uprising in 1969, serves as a powerful reminder of the importance of continuing the fight for transgender rights.
The initial legislative package has been passed to shore up legal resources and healthcare access for the TGNC community, but there is still much work to be done. Enhanced privacy protections are needed for patients receiving gender-affirming care in New York state, and the ongoing efforts nationwide targeting transgender rights must be countered with continued advocacy and legal action.
