The International Criminal Court (ICC) has made a groundbreaking move by issuing arrest warrants for two senior Taliban leaders, Haibatullah Akhundzada and Abdul Hakim Haqqani, for crimes against humanity related to persecution based on gender and political grounds in Afghanistan[1][2][3]. The charges cite the leaders' responsibility for ordering or inducing persecution of women, girls, and gender non-conforming persons, as well as political persecution against those seen as "allies of girls and women." The alleged crimes occurred since the Taliban seized power in August 2021 and continued until at least January 2025[2].

Since the Taliban's return to power on August 15, 2021, women and girls in Afghanistan have been targeted and denied basic rights and freedoms, including the right to education, privacy, family life, freedom of movement, expression, and religion[4]. The Taliban's policies have resulted in severe violations of the fundamental rights and freedoms of the civilian population, including murder, imprisonment, torture, and rape[2][4].

The investigation resumed in late 2022 after a reauthorization by the ICC Pre-Trial Chamber, with close supervision by Deputy Prosecutor Nazhat Shameem Khan[1]. This is the first time arrest warrants have been issued as part of the investigation against the Taliban.

The ICC does not have its own police force and relies on the help of its member states to enforce arrest warrants. The implementation of these warrants depends heavily on international cooperation—ICC member states are urged to arrest the accused and uphold their obligations under the Rome Statute[4].

These arrest warrants represent a significant move by the ICC, highlighting Taliban leaders as criminal actors responsible for systemic gender-based persecution, directly challenging the gradual international normalization of the Taliban regime[4].
