In a continuation of a long-standing legal dispute, the Higher Administrative Court (OVG) in Münster will resume hearings on September 23, 2021, regarding the 2017 evacuation of the Hannibal high-rise complex in Dortmund.

The evacuation, which took place in 2017, forced approximately 400 residents to leave their apartments within a short time. The initial oral hearing on this matter was held on July 7, 2021, with the aim of clarifying whether the city and fire department were justified in immediately evacuating the building due to fire safety defects.

However, the court hearing, which lasted several hours, was adjourned without making a decision. The expert appointed by the court denied an immediate danger in the Hannibal high-rise complex, stating that there was no imminent risk of fire or smoke for the residents in the building.

This opinion contradicts the stance of the city and fire department, who maintain that the evacuation was necessary at the time. The former owner of the complex has also filed a lawsuit against the city's decision, contending that the evacuation was hasty and not necessary.

Representatives of the city and fire department reportedly shook their heads in response to the expert's answers, indicating disagreement with the findings. The building, which has up to 17 floors, was not deemed to be in immediate danger by the expert.

The court hearing will take place at the 7th Senate of the court in Münster, with the outcome of the legal dispute eagerly awaited by all parties involved. It is hoped that the court will provide clarity on this matter and help to ensure the safety of residents in high-rise buildings in the future.
