In a landmark ruling, a Berlin court has sentenced a 38-year-old man to five and a half years in prison for raping an unconscious high school graduate over three years ago. The incident, which took place in Berlin-Steglitz, has left lasting physical and psychological consequences for the victim.

The defendant, a former businessman, met the victim coincidentally at a bus stop on April 22, 2022. The man encouraged the victim to consume various drugs, knowing it could lead to unconsciousness. The rape occurred later that evening, with the defendant filming and humiliating the victim's body.

Initially, police saw no signs of a crime and believed the defendant's account of a "drug accident." However, investigations into the case began several weeks later at the family's insistence. The victim was found lifeless in the defendant's apartment and had to be revived for 12 minutes by emergency services.

The court found that the defendant had raped the victim while she was heavily intoxicated and unable to assess the situation or risks. There was no evidence of blows or restraints, but the defendant's actions were deemed to be a serious violation of the victim's rights and dignity.

The defendant was also charged with severe bodily harm due to the consumption of incapacitating substances. Two more rape charges are now pending against him.

The prosecution sought a six-year sentence for the defendant, while the defense argued for acquittal. However, the court found the defendant guilty of both sexual assault and reckless bodily harm.

The laws regarding drugging and raping an unconscious woman fall under the German Penal Code, specifically sections related to sexual assault and rape. Aggravated cases, such as this one, may result in higher penalties due to the use of a dangerous substance to facilitate the crime.

The victim's life has been irrevocably changed by this incident. She has had to drop out of school due to the trauma and now struggles with fears, difficulty building trust, and a lack of physical intimacy. The court's decision serves as a reminder that such crimes will not be tolerated and that perpetrators will be held accountable.
